Update On Amendment 1 Lawsuit

On December 5, 2016, the Florida Wildlife Federation (FWF) and its allies were in court as to our lawsuit against the Florida Legislature for violating Amendment 1, the Water and Land Legacy Amendment passed in 2014 to increase conservation funding. Also in court were Plaintiffs for a similar case, including the Florida Defenders of the Environment, who are suing state agencies for not spending money in conformance with the Amendment. While these cases are similar, they assert different legal theories as to misappropriation of funding stemming from the passage of the Amendment, which was approved by 75% of voters.

In the interest of expediting the legal process, FWF withdrew our Motion for Summary Judgment that was originally scheduled to be heard Monday and agreed to the consolidation of the cases against the Legislature and the state agencies. Our Amended Complaint should be filed by the first week of January 2017.

Litigation is a long and costly process, but we are determined that the people of Florida must be listened to and that our environment must be protected for ourselves and future generations.
